GENERAL TERMS AND CONDITIONS OF PARTICIPATION

TEVEO GmbH Dr.-Zumach-Ring 6, 91522 Ansbach – hereinafter referred to as “TEVEO” – for the free use of the Pull-Up Challenge by TEVEO GmbH, Dr.-Zumach-Ring 6, 91522 Ansbach, as a participant at RiminiWellness, 28–31 May 2026 in Rimini, Italy, Pavilion A7, Stand 160.

§ 1 Scope

These General Terms and Conditions of Participation (“GTC”) comprehensively and conclusively govern the legal relationship between TEVEO GmbH as organizer and you as participant in the Pull-Up Challenge. The GTC form an integral part of the agreement that you enter into with us by registering as a participant.

§ 2 Registration in the TEVEO App

Your registration as a participant in the Pull-Up Challenge requires:

  • Consent to the storage and processing of your data within the framework of the app registration in accordance with the separately available privacy policy under the GDPR.
  • Confirmation of your agreement with these GTC.

The agreement regarding your free participation in the Pull-Up Challenge is concluded upon registration in the app and acceptance of these GTC.

§ 3 Additional Participation Requirements: Age and Health Condition

In order to participate in the event – use of the Pull-Up Challenge – you must:

  • Be at least 18 years old on the day of the event.
  • Be in good health and physical condition.

You are solely responsible for assessing whether you meet the health requirements for participation.

However, you accept that TEVEO GmbH staff may deny you access to the Pull-Up Challenge if there are justified doubts, based on obvious facts, regarding your physical condition or health.

You also accept that TEVEO GmbH staff may require proof of age by means of a valid photo ID (identity card, passport, driver’s license) if there are doubts regarding your age.

As organizer, we reserve the right to exclude you from participation at any time and/or disqualify you retrospectively from the ranking if you intentionally provide false personal information during registration or afterwards, or if you endanger or disrupt the safety of other participants, spectators, staff, or the proper conduct of the event before, during, or after participation.

§ 4 Participation Risk, Liability, Limitation of Liability and Exclusion of Liability

Participation is at your own risk and requires that you are healthy and in good physical condition. It is your responsibility to verify your health condition beforehand if in doubt.

By registering and participating, you expressly declare that you are aware of the specific risks of the event and that there are no health concerns regarding your participation.

By registering for participation, you acknowledge that during participation you may suffer injuries through tripping, falling, collisions with equipment or barriers, overexertion, etc., or become infected with SARS-CoV-2 or other viruses.

Subject to clauses § 4.5 and § 4.6 of these GTC, TEVEO GmbH excludes all liability for losses, damages, or injuries to you and/or your property.

TEVEO GmbH does not exclude liability for fraud or fraudulent misrepresentation, intent or gross negligence, or injury to life, body, or health.

TEVEO GmbH is liable for negligent breaches of essential contractual obligations. Liability is limited to foreseeable and typical contractual damages.

Claims under product liability law remain unaffected.

TEVEO GmbH assumes no liability whatsoever for lost clothing, valuables, or equipment belonging to participants.

§ 5 Data Protection, Photo/Film/Video Recordings and Image Rights/Usage Rights

You acknowledge and agree that TEVEO GmbH may use the information you provide for specific purposes.

TEVEO GmbH is entitled to make audio and video recordings as well as photographs of the event.

TEVEO GmbH may use these recordings for documentation, information, and advertising purposes in all media.

You agree to the publication of the recordings without compensation.

§ 6 Intellectual Property Rights

TEVEO GmbH is the sole owner of the TEVEO GmbH brand and all associated intellectual property rights.

§ 7 Final Provisions, Applicable Law and Jurisdiction

The agreement contains all arrangements relating to your participation.

The agreement is governed by the laws of the Federal Republic of Germany.

We are neither willing nor obliged to participate in dispute resolution proceedings.

PRIVACY POLICY

We take data protection seriously

Protecting your privacy when processing personal data is important to us.

When you register for our offers at RiminiWellness, we use the personal data you provide to administer the competition as well as photo and film recordings for public presentation.

Your data will only be used for the stated purpose. Your data will be treated confidentially and will not be shared with third parties.

When you use one of our services, we generally only collect the data necessary to provide the service. Additional information may be requested voluntarily.

Whenever we process personal data, we do so in order to provide our service or pursue our legitimate commercial interests.

2. Personal Data

Personal data are data relating to your person. This includes your name, address, email address, as well as photo and film recordings.

In some cases, we require your name, address, and additional information in order to provide the requested service.

We only store data voluntarily provided or transmitted by you.

3. Contact

When contacting us (e.g., via contact form, email, phone, or social media), the information provided by the inquiring persons will be processed insofar as this is necessary to answer the inquiries and any requested measures.

  • Performance of a contract and pre-contractual inquiries (Art. 6 para. 1 lit. b GDPR)
  • Legitimate interests (Art. 6 para. 1 lit. f GDPR)

4. Processing of Personal Data for Advertising Purposes

Unless you object, we use the email address you provided when purchasing goods or services in order to send electronic advertising for our own similar goods or services.

Legal basis:

  • Art. 6 para. 1 lit. f GDPR
  • Section 7 para. 3 UWG

You may object at any time pursuant to Art. 21 para. 2 GDPR.

5. Participation in the Pull-Up Challenge

To participate in the Pull-Up Challenge at our trade fair stand at RiminiWellness, registration is required.

For this purpose, we process your first name, surname, date of birth, gender, and email address.

The legal basis is Art. 6 para. 1 lit. b GDPR.

6. Processing of Photo and Film Recordings for Advertising Purposes

By accepting the GTC before using the Pull-Up Challenge, you enter into a contractual relationship with us. Use is only possible if you also agree that we may take photos and film recordings of you.

The recordings will be published as part of our public relations work, especially on our social media channels.

You agree to publication even though photos, videos, and data may not be fully deletable.

7. Competition – Digital Wheel of Fortune

If you participate in one of our competitions, we process the following data: name, contact details, and possibly social media profile.

8. Security

We have implemented technical and administrative security measures to protect your personal data.

9. Which data are processed and from which sources do these data originate?

We process the data received within the framework of contract initiation and execution.

9.1 For which purposes and on which legal basis are the data processed?

Processing is carried out for contract fulfillment, fulfillment of legal obligations, protection of legitimate interests, and on the basis of your consent.

9.2 Who receives my data?

Recipients may include IT service providers, authorities, or other contractual partners.

9.3 How long will my data be stored?

Storage takes place until termination of the business relationship or expiry of statutory retention periods.

10. Your Rights

10.1 Right of Access

You may request information as to whether and to what extent we process your data.

10.2 Right to Rectification

You may request correction or completion of inaccurate or incomplete data.

10.3 Right to Erasure

You may request deletion of your data if processing is unlawful or disproportionately interferes with your legitimate interests.

10.4 Right to Restriction of Processing

You may request restriction of processing under the conditions provided by law.

10.5 Right to Data Portability

You may request that we provide your data in a structured, commonly used, and machine-readable format.

10.6 Right to Object

You may object at any time to processing based on legitimate interests, including profiling.

You may object to the processing of your data for direct marketing purposes at any time without stating reasons.

10.7 Right to Lodge a Complaint

If you believe that we violate German or European data protection law, you may contact us or the competent supervisory authority.

10.8 Am I obliged to provide data?

The processing of your data is necessary for the conclusion and fulfillment of your contract with us. If you do not provide the required data, we may have to refuse or terminate the contract.
